4 Montrose bars overserved drunken driver who killed man on first date, lawsuit claims
Four Montrose bars have been added to a civil lawsuit claiming an allegedly drunken driver — who has been accused of— had been overserved at the establishments.
Local bars Eagle, Ripcord, Lola's and JRs are being sued by the family of Joseph McMullin, who was killed in an auto-pedestrian crash early April 20. McMullin, 33, was on a first date at a donut shop and had been walking along the 1200 block of Westheimer Road when a driver lost control of a sports car andA woman told police investigators the pair had been on the sidewalk when a blue Porsche 911 Carrera came around the corner, its driver lost control and the car came up onto the sidewalk.
Chambers' husband also was added to the lawsuit for irresponsibly allowing his wife to drive the vehicle after drinking. The family seeks more than $1 million to compensate them for the death of their oldest son. Chambers’ criminal defense attorney has said Chambers did not have a blood alcohol concentration of four times the legal limit and at one point filed a motion to suppress the introduction of the blood results into evidence.
