The former Bishop Canevin star is going after the newspaper for a story it published in March.

He is represented by attorneys Matt Glover and Stephen P. New, who are making an argument “on the basis of defamation/libel and false light invasion of privacy,” according to USA Today.According to the report, Spears contends that he and two friends met with Miller along the strip and then ate at a barbecue restaurant. That’s when they say that another teammate, Jaden Bradley, called Miller via FaceTime an asked Miller and his friends to go out.

The report said that Spears’ complaint said that he demanded through counsel that the Times retract its story. The newspaper has yet to do that so Spears’ suit accuses it of failing “to use reasonable care in publishing and disseminating the untrue statements regarding Plaintiff Spears’ presence at a crime scene.”

His attorney are also arguing that he “suffered severe emotional distress, mental anguish and loss of enjoyment of life as a result of the article,” according to the report. Spears, who is the son of Marshall Athletic Director Christian Spears, was never accused of any wrongdoing. He was a freshman walk-on for the Crimson Tide last season after playing his high school hoops at Bishop Canevin.
