A task force will review conflicts between rules for lawyers and state law — an issue that arose in complaints against Attorney General Mark Brnovich.
Does Arizona need to strengthen its rules preventing conflicts of interest for attorneys who represent government bodies?
"The state attorney general, county attorneys, and other public lawyers have unique roles and statutory responsibilities in the justice system," a Feb. 16 order from the Arizona Supreme Court creating the task force reads."The current Arizona rules of ethics for attorneys might not adequately contemplate or address those unique roles and the potential conflicts of these public attorneys.
The complaints alleged Brnovich violated rules for attorney conduct and his duties to represent the state when he filed lawsuits against the regents; and that he failed to adequately represent the secretary of state and mishandled election-related lawsuits. “This has been an issue for a number of years and it’s time we take a serious look at addressing potential conflicts for public attorneys,” Chief Justice Robert M. Brutinel said in a statement., he didn't mention his deal with the State Bar of Arizona was a diversion agreement, which included a corrective action plan. The details of the agreement are confidential and though Brnovich could release them, he has not.
