Council says it has 148 live enforcement investigations relating to unauthorised short-term lets
Belfast City Council is demanding Stormont clarify regulatory powers to fight AirBnB “cowboys” after a councillor accused Executive departments of “passing the parcel” on responsibility for short-term let accommodation.
The Department for Communities told the council policy responsibility for Airbnbs and short-term tourist accommodation lies with the Department for Economy and its “arm’s length body,” Tourism NI. The Department for the Economy added it has responsibility for the implementation of the Tourism Order but added the scope of the order is tightly defined and limits Tourism NI to inspecting properties to ensure that they meet a minimum standard of safety, cleanliness, and the provision of facilities.
In June this year, the High Court ruled in favour of Belfast Council and quashed two Planning Appeals Commission decisions on two applications in the city centre where the PAC overruled council refusals for short term accommodation applications. “The council has to operate currently with one hand tied behind its back because enforcement frankly is very limited. And that can really only apply to individual properties.
He added: “We have seen in the Holyland, Stranmillis and Lower Lisburn Road, the impact of the unfettered growth of HMOS on the sustainability of those communities. The risk is this happens with AirBnBs and other short term lets, so we need action. The Executive seems to have no real intention to do that.”
