A carer was unfairly dismissed after damaging a disabled woman's mobility scooter and refusing to attend work having been in contact with someone who had Covid.
The employment judge added: "She had been looking for part-time work which would provide her with some funds while fitting in with the projects that she wanted to undertake and enabling her to spend time with her grandchildren." Although the disabled woman disputed she had said that the employment judge said: "We prefer the claimant’s version of events. We find that the respondent was angry with the claimant for “leaving her in the lurch” and that overrode any concerns she had about COVID.
In November 2020 the carer accompanied the woman on a trip to the local park. However, the woman "soiled herself on the way there", and after they returned home she asked the carer to use a bowel irrigation kit to prevent a reoccurrence.
