Hello, Deadline: Legal Blog readers! I had the chance on Thursday to interview Colorado’s secretary of state, Jena Griswold. She’s at the center of a lawsuit launched by voters hoping to keep Donald Trump off the ballot, citing the 14th Amendment’s ban on insurrectionists holding office.
I’m wondering, then, doesn’t it eventually have to be resolved by the Supreme Court? Obviously, the Supreme Court has discretion over its docket, but tell me why the following scenario could or couldn’t play out, where you have different states with different mechanisms for their own ballot procedures: Could Donald Trump be on the ballot in one state and not in another for the 2024 election? JG: It’s premature to say if that will happen or not. These cases can be appealed.
