Since March 2020, the U.S. has relied on the pandemic-related public health order known as Title 42 to quickly expel migrants and asylum seekers more than 1.6 million times.

Many migrants have been returned to dangerous Mexico border cities where cartel violence and kidnappings are rampant. The ruling by a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit says the federal government can no longer expel migrant families back to countries where their life or freedom will be in danger. The D.C. ruling does not apply to individuals and the U.S. government earlier excluded unaccompanied minors from Title 42.

In a statement, the ACLU, one of the parties that sued the Biden administration to halt the order, said the injunction will “end the use of Title 42 for families fleeing danger, as currently employed.” Lee Gelernt, the ACLU attorney who argued the appeal and is deputy director of the ACLU’s Immigrant Rights Project, said, “This is an enormous victory. We have argued from the beginning that the Title 42 policy is illegal and inhumane, and every court to address the issue has agreed. The court’s ruling leaves no doubt that this brutal policy has resulted in serious harm to families seeking asylum and must be terminated.
