And for those in the Gulf Coast who fled their homes before Ida struck, officials are asking them to stay away until the area is safe as there are downed power lines, debris and major flooding. The short answer is in Louisiana, you don’t have to pay rent if your home is uninhabitable because of a natural disaster, but you’ll have to break your lease.

If you want to get out of the lease, then you should write to your landlord immediately . Let them know that you would like to terminate the lease because the property can’t be lived in. “Asking the tenant to take steps to terminate the lease would be nice, but you can’t expect them to,” Gouner says. “If the landlord tried to collect the rent and the place was uninhabitable, the judge is probably going to rule against them. I’ve represented landlords for over 20 years and I’ve never had anyone try to collect rent on a place the tenant couldn’t live in.”
