A bipartisan group of former Ohio Attorneys General want Ohio General Assembly members to halt a drive by the legislature’s Republican majority to raise the threshold of voters required to amend Ohio’s constitution from a numerical majority to a 60% vote.
. Both the Senate resolution and the bill scheduling the August election are scheduled for possible votes in two House committees on Tuesday, setting up the potential that they could be voted out of the House this week.
The legislature generally eliminated August special elections in December, except when local governments in fiscal emergencies needed to raise funds. DeWine signed that bill earlier this year. August elections are expensive – estimates for the Aug. 8 election are around $20 million – and historically have experienced low turnout, usually around 10% or fewer of registered voters participate.
“As former Ohio Attorneys General, we are in a unique position to comment on the process for amending our state constitution,” their letter said. “We have reviewed proposed initiated amendments to assure that their summaries are ‘fair and truthful,’ and some of us have represented state officials in litigation involving an initiative.
They said Ohio’s current procedure to amend the constitution has worked well, noting it’s been used to adopt policies that include county home rule, the 10-mill limitation on unvoted property taxes, the prohibition of taxes on food, the elimination of straight party ticket voting, the adoption of legislative term limits, and the adoption of the minimum wage.
