“It is no overstatement that democracy stood on the precipice.” California State Bar, in its complaint against former Chapman University law professor and Donald Trump lawyer John Eastman.

A federal judge said on March 28 that former President Donald Trump and attorney John Eastman may have “corruptly attempted to obstruct” the Jan. 6, 2021 congressional certification of the presidential election. June 21, 2023 at 3:52 a.m.

Attorneys for the State Bar tried to show that Eastman filed bad information with courts and encouraged state legislatures to pursue illegal strategies to overturn Trump’s losses. Eastman countered that he was working under extreme time constraints with information that was changing rapidly, and that he told state legislators that they should proceed only if their investigations found serious fraud and illegalities.

Did Eastman verify the analysis that he used to conclude that there was likely fraud and irregularities in the vote, a report done by a certified public accountant with no training or experience working with elections data? Did he know that an expert from MIT concluded that the analysis used flawed data and was based on misunderstandings of law?

In his opening statements, Miller said that, in addition to tenability and free speech, this case revolves around two other vital issues: an attorney’s responsibility to advocate for his client, and his right to petition. Eastman sought to avoid any public test of his theory, and confessed to Pence’s attorney that it had no chance of surviving a court challenge. He was fully aware his plan was damaging the nation, and even after violence erupted at the Capitol — putting Pence, his family and members of Congress in danger — Eastman continued to press “his illegal scheme” and blamed Pence for the chaos.
