The lawsuits were filed against four public state universities that began requiring students and staff to get COVID-19 vaccines during fall semester.

What authority do universities have to make health orders?

For instance, the 1905 Supreme Court case Jacobson vs. Massachusetts, which determined that state legislatures have the power to enforce public health policies, has long allowed governments to have that privilege. That same decision also allowed local health departments to determine when mandatory vaccines were necessary, like during a small pox epidemic.to declare health orders when DeWine signed House Bill 244 in July.

"This is not trivial; this is about saving lives," she said."This disease has taken well over 800,000 lives. Requiring vaccines, masks and frequent testing us such a minimal ask to save human life." Court dates for the suits filed against Ohio University and Bowling Green State University have yet to be scheduled. A Hamilton County Common Pleas court will hear the University of Cincinnati's case in March.

"We’re confident in our vaccine policy, which requires all students, faculty, and staff members to be vaccinated against COVID-19 unless exempted," said Miami University spokeswoman Jessica Stark Rivinius. "Like the Centers for Disease Control and Prevention , the World Health Organization, and numerous public health officials, we believe that vaccination against COVID-19 is key to ensuring the health and safety of our campus community.
