And while the commission could establish a band of rates to be charged, that band couldn’t be so elastic as to abdicate its constitutional duty to establish “just and reasonable rates.” The Green Mountain Energy application offered a small-scale pilot project in retail competition in Arizona, with the Phelps Dodge safeguards firmly in place. The company felt that the state statutes compelled the commission to process its application.
Nevertheless, Ducey justified his signing of the legislation, saying that the existing statutory competitive scheme was “outdated and unused.”
