A challenge of whether the former congressman met the residency requirement was denied and dismissed.

WILLIAMSPORT -- Former U.S. Rep. Thomas A. Marino’s name will remain on the Republican primary ballot as a candidate for Lycoming County district attorney.set aside his nominating petitions.

A spokesperson for Marino said the ruling was expected and added, “A judge who knows the law has tossed out a spurious challenge filed by an attention-seeking gadfly. With this nonsense out of the way, Tom can now move forward with his campaign to deliver experience and legal skill to an important job that helps to keep our public safe.”The issue centered on a condominium Marino and his wife Edith bought in Vero Beach, Florida, on Sept. 29.

Marino, 70, countered he did not vote in Indian River County but registered there so that with his political background he could help the Republican executive committee with candidates. Records show he never canceled his registration in Lycoming County. Registering to vote and licensing a vehicle alone do not indicate an intent to be domiciled in Florida. He removed himself from the Florida voting rolls on Feb. 1, four days before he announced his candidacy for district attorney, a position he held from 1992 to 2002.He never worked or voted in Florida, only paid real estate taxes as a condominium owner, and did not sell his Pennsylvania residence or move his household goods.
