The Supreme Court announced Sunday that Justice Clarence Thomas has been hospitalized since Friday evening “after experiencing flu-like symptoms.”

Thomas, the court’s most senior conservative—and, at 73, its second oldest—“will participate in the consideration and discussion of any cases for which he is not present on the basis of the briefs, transcripts, and audio of the oral arguments,” the Supreme Court’s statement said. He will not participate remotely in oral arguments over the phone on Monday, the Supreme Court spokesperson told CNN.

The court “offered no explanation for why it waited two days to disclose that the justice was in the hospital,” the Associated Press —an opaqueness that SCOTUS experts say is characteristic when it comes to reports on justices’ health. “The court’s Public Information Office is not known for timely release of medical details,” Slate’sin an email. The court’s veiled approach to health updates, which are left to the discretion of the individual justice, has been “a big problem for the press and the public,” she noted.
