In Webster’s letter, the first assistant attorney general noted that the Texas Constitution guarantees Paxton a salary as long as he remains the duly elected attorney general. And that while the Constitution states any impeached elected official must be suspended from duty, it makes no determination about the official’s salary.
North conceded that the situation is “unprecedented” but reiterated that the state budget provided funding for only one attorney general. Paying Paxton for the time he was suspended put taxpayers on the hook for his salary and the salaries of interim attorneys general appointed to head the office while the articles of impeachment were pending.
