Kevin Berling had an anxiety attack when the company he worked for threw him a birthday party, even though he asked that it not be held. Days later he was fired.

, two managers at the company confronted Berling the next day, questioning his reaction to the party. The meeting reportedly prompted Berling to have another panic attack.

Two days later, Berling was fired from his job, NBC News reports. A letter said he was fired “because of the events of the previous week,” according to Berling’s lawsuit. The company said Berling became violent during the meeting with the company managers and that was why he was fired, the Times reports.his client has no history of violence and said people having panic attacks usually are incapacitated by fear.

“Basically what the argument was is he was fired for having a panic attack,” Bucher tells linknky.com. “They made assumptions that he was dangerous based off of his disability and not off of any evidence that he was violent.” A jury sided with Berling after a two-day trial, awarding him $150,000 in lost wages and benefits and $300,000 for suffering, embarrassment and loss of self-esteem, the Times reports. A lawyer for Gravity Diagnostics tells the Times the company will appeal.
