In this hyper-partisan judicial environment, it is highly unlikely that Jackson’s voice and vote will make much of a practical difference—instead, she’ll be in dissent a lot, voting alongside justicestwo Democratic appointees whose sound and fury have gotten louder as the Supreme Court has lurched further and further to the right.
Since Biden made his desire to nominate a Black woman known during the Democratic primaries, there have been attempts, which will continue, to suggest that his nominee would be chosenof her skin color rather than her own unflappable credentials and life in the law. Those protestations should be laid to rest, as Jackson has it all:; clerkships with judges at all levels of the federal judiciary, including with Breyer at the Supreme Court; and experience in collegial bodies, including on the U.S.
But there’s no item on her résumé that makes Jackson a stand-out, and a history maker twice over, as much as her past as a public defender—the first lawyer since Marshall himself to have significant experience representing people threatened with incarceration. Senate Republicans, much as they did when she was up for the D.C.
