The case was referred to the Los Angeles City Attorney’s Office for consideration regarding a misdemeanor filing because officials determined there was not sufficient evidence to constitute a felony. According to prosecutors, Lee's actions did not meet the felony standard for assault with a deadly weapon, as he did not present the weapon during the incident.
Gascon’s office does not prosecute misdemeanors that occur in LA, the Los Angeles County District Attorney's Office said in a Thursday statement.An investigation into how Lee managed to get through the security around Chappelle is underway.
