Appeal judges ruled Robert Major\u0027s trial relied heavily on speed analysis that did not meet the reliability threshold for admissible evidence.
In a decision released Wednesday, the appeal judges ruled information obtained from an event data recorder about the speed Major was going right before the crash was admitted into evidence at his Saskatoon Court of Queen’s Bench trial “without a proper foundation.”
Major was driving a Dodge Ram pickup loaded with six passengers — none of them wearing seatbelts — when he failed to stop at the intersection of Range Road 3083 and Highway 16 in the early morning of Feb. 22, 2016. His two sons, nine-year-old Theodore Cardinal and four-year-old Brenden Major, and his girlfriend, 26-year-old Kimberly Oliverio, died in the crash. His five-year-old son, 11-year-old nephew and a co-worker were severely injured.
A collision reconstructionist who analyzed the EDR data concluded that “The cause of the collision was the driver of the Ram travelling at an elevated speed and not perceiving the approaching intersection in time to stop the Ram before crossing the highway into the path of the freight-liner in the westbound lanes.”Article content
