Daniel Carnevale, who spent 14 years in prison on a conviction of setting a deadly fire before winning a new trial and eventually his freedom, has sued the police who investigated him and the prosecutor who put him behind bars.
Mr. Carnevale filed the complaint in U.S. District Court on Thursday, accusing the law officers of fabricating evidence, withholding evidence favorable to him and “orchestrating the use of false testimony” from an alleged jailhouse informant they had coached.
The case stems from the January 1993 fire at the Columbia House and Regal Apartments on Taylor Street in Bloomfield that killed Anita Emery, Florence Lyczko and Chris Stahlman. Police didn’t arrest anyone until 13 years later, when two cold-case officers, Mr. Evans and Mr. Smith, said a new witness came forward. They arrested Mr. Carnevale and he went on trial in 2007. He was found guilty of three counts of second-degree murder and sentenced to life. He kept appealing and eventually won a new trial, but the district attorney’s office withdrew its case before it could happen and he was freed in 2020.
“Evans and Smith knew that [the witness] — for more than 13 years — never previously claimed that he knew the identity of the white male that he alleged to have seen leaving the courtyard of the Columbia on January 17, 1993,” the suit says.
