that around 285,000 people had their wages garnished between March 13 and March 26, 2020. So many borrowers were still having their pay withheld that Student Defense, a nonprofit organization dedicated to protecting student loan borrowers and the National Consumer Law CenterIn October 2020—just a little over seven months after the new rule was implemented—reported the department was still receiving wage garnishments for 1,930 borrowers.

The Department of Education claims it hasn’t refunded these borrowers because it does not have their correct address on file. The payment pause on federal student loans, without interest, has been extended through January 21, 2022. The extension also prohibits wage garnishment on defaulted loans. If you’re one of the nearly 11,000 borrowers still waiting on a refund for illegally garnished wages during the pandemic, there’s not much you can do. The Department of Education may have attempted to contact you to gather updated information, such as your address. Keep an eye out in the mail for any official correspondence, and act accordingly.

If your student loans will still be in default once the forbearance period ends early next year, the best step to take is to call your student loan servicer and discuss your options to pull your loans out of default.
