Last year the Colorado legislature passed a bipartisan bill, SB21-271, that overhauled the state’s misdemeanor code. And lawmakers are already working on tweaks.

that included both Democratic and Republican elected officials, prosecutors, defense attorneys and leaders from various other corners of the legal system.

As for the remaining 550 or so felonies not covered by the Victim Rights Act, federal law still prohibits gun possession by people with previous felony convictions. Colorado can’t promise them immunity from being prosecuted on those grounds. But while the legislature can’t control what federal prosecutors do, it can control state prosecutors.

Before the new law went into effect Tuesday, convictions for each of the 600-plus different kinds of felonies in the state could lead to the same baseline penalty of 12-18 months in prison — a level six felony, the least severe kind — for a gun possession violation. In agreeing to cut that number down just to people with Victim Rights Act convictions, the legislature also decided to stiffen the penalty to a level five felony. The sentencing ceiling grew to three years.

“These are very, very dangerous offenses that are underlined here,” Delta Republican state Rep. Matt Soper, a sponsor of the bill, said at a Tuesday committee hearing for his bill.
