The New Jersey legislature has passed what a local environmental group is calling the strongest single-use ban on plastics in the country, which would prohibit grocery stores and restaurants from bagging items in single-use plastic or paper bags, while also banning the use of polystyrene boxes, commonly called styrofoam boxes, for take-out food.The legislation will go into effect in 2022 if signed into law by Gov. Phil Murphy , which he is expected to do.
Customers will only be able to get plastic straws from restaurants by request after the law goes into effect. Businesses will be able to apply for a waiver of the to-go box restrictions for one year if there is either “no feasible and commercially available alternative for a specific polystyrene foam food service product” or if the business has less than $500,000 in gross annual income and cannot find an affordable alternative.
The ban also applies to most foam cups commonly used to hold hot coffee, with the bill limiting the allowance for foam cups to “two ounces or less, if used for hot foods or 22 foods requiring lids.” Fines of up to $5,000 could be issued for third offense and subsequent violations, with that money being directed to the state’s Clean Communities Program Fund.“New Jersey Assembly voted to pass the strongest single-use ban on plastics in the country to prioritize our wildlife and our communities over endless plastic waste polluting our waterways,” Doug O’Malley, the director of Environment New Jersey, said in a.
