A Grand Jury has voted not to file criminal charges against the police officer who was pursuing a vehicle before it became involved in a fatal crash, New Jersey Attorney general Matthew J. Platkin said.
Montclair Police officer Michael Kupchak attempted to conduct a stop on the vehicle, driven by Dukes, as part of a robbery investigation. After the suspect vehicle failed to pull over, Kupchak pursued it for a short period of time, while a second officer, Brandon Taylor, followed behind his patrol car, authorities said.
“I’m following these guys. They took everything. I’m not leaving them to police, they took all my money, suitcases everything,” the man said to the 911 dispatcher. A further investigation found that Kupchak started to slow down and terminated the pursuit after about 20 seconds, when the vehicle was rapidly accelerating, according to the Office of the Attorney General. About 40 seconds in, Dukes’ car lost control and struck a tree, officials said.
