But Wes Mau, the county’s Republican district attorney since 2014 who did not seek re-election this year and is exiting office on Jan. 1, sent a letter to the Office of the Attorney General on Dec. 8 asking for a formal written opinion on the marijuana decriminalization ordinance. In the request for the attorney general’s opinion, Mau argues that local ordinances cannot supersede state law that criminalizes marijuana possession and delivery, and San Marcos’ new law will be directly at odds with Texas drug laws.
