David Sherborne, representing Prince Harry, is on his feet to question Marcus Partington.
Asked if it was correct that the legal department knew the nature of sources for stories published in Mirror newspapers, Mr Partington said this wasn't the case. He adds that legal advice was"only sought" and therefore would not necessarily be"accepted or followed". "I do not consider it would be in the interest of fairness of the trial as a whole that this new evidence be admitted at such a late stage," he said, explaining his judgement.Legal teams argue over new evidence to 'scare off witnesses'
Mr Sherborne argues that the evidence is"important" and"there was good reason" why it could not have been provided sooner.
