The law firm will analyze whether being a licensed lawyer, but not a practicing one, meets the city's experience requirement

But City Attorney Mara Elliott plans to follow through on plans to seek an independent legal analysis of the Assemblymember’s eligibility, as he denounces questions as reckless political gamesmanship.Maienschein faces questions over whether he meets a city requirement that candidates for city attorney must have been licensed to practice law for at least 10 years.

Elliott said in early May that there is enough uncertainty about Maienschein’s eligibility to warrant a legal analysis. She said she chose not to handle the analysis because another candidate in the race works for her office — Deputy City Attorney Heather Ferbert. The contract with Aleshire & Wynder pays the firm $30,000 immediately and limits the total payout to $50,000, but the council could vote to increase that amount if necessary.

On Wednesday, Rottenstreich said what’s costing taxpayers money is Maienschein’s insistence on running without enough legal experience. “A career politician who hasn’t practiced law in a quarter century is obviously unqualified to be the city’s top lawyer,” Rottenstreich said.
