. However, the legal question is whether Congress granted the president the power to cancel unlimited student loan debt — through the Higher Education Act of 1965 or other legislation — or whether Congress needs to provide additional authorization.
“[Biden] asked his secretary of education — who’s just been on the job a few weeks — once he got on the job to have his department prepare a memo on the president’s legal authority, and hopefully we’ll see that in the next few weeks,” White House Chief of Staff Ron Klain said in March. However, weeks turned into months. Now, it’s been more than six months, and the Education Department hasn’t released that memo.
