The Supreme Court refused the Trump administration's request to block a lower court order demanding increased efforts against the spread of the coronavirus at a low-security federal prison in Ohio.

The Supreme Court ruled earlier this month against two elderly federal prison inmates in Texas seeking protections from the coronavirus. Another case is pending in Louisiana.warned that "while states and prisons retain discretion in how they respond to health emergencies, federal courts do have an obligation to ensure that prisons are not deliberately indifferent in the face of danger and death.

The Supreme Court noted Tuesday that the Justice Department only appealed Gwin's initial order and can still contest the later one. Nevertheless, Francisco acknowledged that nine Elkton inmates have died from the virus. The ACLU says another 162 prisoners and seven staff are currently COVID-positive.
