Under a temporary injunction, the abortion ban could no longer be enforced on pregnant Texans with medically-complicated pregnancies. If Connor doesn’t grant the injunction, the ban will continue while the case is litigated — a process that will likely take months or years.
Should Connor dismiss the case altogether, the plaintiffs would likely appeal the decision to the Austin-based Third Court of Appeals. Democrats comprise the entire six-member court.Regardless of this lawsuit’s outcome, Mohapatra said, there will be more lawsuits challenging Texas abortion bans. These lawsuits could represent a broader spectrum of people, including those who want to terminate a pregnancy without an emergent medical complication.
And cases likely won’t stop at abortion. Other laws that dictate medical decisions in Texas, like the state ban on gender-affirming medical care for transgender teenagers, could soon face similar legal challenges. “We are seeing more and more where the hands of physicians are tied because of state political actions,” Mohapatra said. “I think we’re going to see lawsuits on both sides questioning these kinds of invasions into the standard of care where the state is creating a standard of care.”
