A vote of 4-2 by the City of Tucson’s Board of Adjustment ultimately affirmed an appeal by associates of Downtown Dispensary that will allow the business to build out another 2,000 square feet of space to expand operations.

“It’s not a school,” he said in an interview before the BOA meeting. “It’s just not. It’s a studio, it’s a tile shop.”In her official final zoning determination in March this year denying the expansion request, Hamblin said that, although “Santa Theresa Tile Works has been legally permitted as an ‘Art Studio,’” that fact “does not preclude it as a location for the study or instruction of art.”

During Wednesday’s hearing, Jesse Callahan, the attorney for Downtown Dispensary, pushed back against Hamblin’s ruling.Callahan presented emails from Michael Crawford — co-owner of the Prime Leaf dispensaries and a former Tucson City Council member — to Hamblin indicating that Downtown Dispensary was planning to expand, and that she should be aware of Santa Theresa’s agreement to run classes for Imago Dei.

For his part, Crawford confirmed that he and Asnani have an acrimonious history, and that his notifying the zoning commission of the studio’s work with Imago Dei had everything to do with that history. Hamblin retorted that, while she was not with the city during the time those licenses were issued, the issue at hand of expansion of a marijuana facility would still be prohibited.
