The U.S. Supreme Court is considering whether Alabama is giving fair representation to Black voters in places like Union Springs, Ala.. The people suing argue the state should have a second majority-Black or majority-Democratic district.

On an October afternoon in Union Springs, small children in princess, Spiderman and Superwoman costumes line up with parents to get handed candy from a truck bed. A high school marching drill team performs a routine on the town’s main street in front of stores, now vacant, that, in better times for Union Springs, sold furniture and housed dry cleaners.

Alabama then appealed to the U.S. Supreme Court, arguing that race is not a legal basis for redistricting decisions. The court decided to hear the appeal on a shadow docket, which is an emergency order on a procedural issue that does not require oral arguments., is 69.5 percent African American with 30.8 percent of people living in poverty, according to U.S. Census data. There isn’t a community center here, and there aren’t enough after-school programs for children, said Jones.

“It’s scary to me that we really that we really don’t have rights,” said Pitts, who manages a retail store and feels that the local leadership lacks qualifications and there needs to be investment in schools.“I would hate that anybody, any Alabamian feels like that they don’t have a say or someone won’t listen to them,” said Terry Lathan, the former Chairwoman of the Alabama Republican Party. She said she believes the Constitution directs states to create districts based on population, not race.

He sees districting battles now as being a grassroots fight, regardless of how the higher court decides on his case. “We just were left without anything, and it’s just remained the same. A stronger voice would really help,” he said, especially for aggressively pursuing industry and improving education.
